Welcome to the Lefa Supply website (the "Website"). These Terms and Conditions govern your use of the Website and the purchase of any goods or services offered by Lefa Supply (Pty) Ltd. By accessing and using the Website, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
1. Definitions and Interpretation
- Lefa Supply / We / Us / Our: Refers to Lefa Supply (Pty) Ltd, a business registered in the Republic of South Africa.
- Customer / User / You: Refers to any person or entity accessing or using the Website or purchasing Goods from us.
- Goods: Refers to the products advertised, sold, or supplied by Lefa Supply via the Website.
- ECTA: The Electronic Communications and Transactions Act 25 of 2002.
- CPA: The Consumer Protection Act 68 of 2008.
2. Acceptance of Terms
2.1. These Terms and Conditions apply to all transactions and interactions conducted through the Website.
2.2. By placing an order, checking the "I Accept" box (where applicable), or using the Website, the Customer is deemed to have read, understood, and accepted these Terms and Conditions.
2.3. If you do not agree to be bound by these Terms and Conditions, you must immediately exit the Website and refrain from placing an order.
3. Formation of the Contract of Sale
3.1. Price Display: The prices of Goods displayed on the Website are inclusive of Value Added Tax (VAT), where applicable, but exclude delivery charges.
3.2. Offer and Acceptance (ECTA Compliance): The display of Goods on the Website constitutes an invitation to do business. Your order constitutes an offer to purchase. The contract of sale will only be concluded when we: * Accept your payment; and * Dispatch the Goods to you, as confirmed by a Shipment Confirmation email.
3.3. Cancellation: Lefa Supply reserves the right to cancel an order at any stage before dispatch due to stock availability, incorrect pricing, or other errors. If we cancel your order, we will notify you immediately and issue a full refund.
4. Payment, Pricing, and Stock
4.1. Payment Methods: We accept payment via EFT/Bank Transfer.
4.2. Pricing Errors: In the event that a product is listed at an incorrect price due to a typographical error or error in pricing information, we shall have the right to refuse or cancel any orders placed for the product listed at the incorrect price.
4.3. Stock Availability: All orders are subject to stock availability. If we cannot supply all the Goods you ordered, we will offer to process a partial order, offer a substitute product, or issue a full refund for the unavailable items.
5. Shipping, Delivery, and Risk
5.1. Shipping Policy: All details regarding delivery times, shipping methods, and costs are set out in our separate Shipping Policy, which is incorporated into these Terms by reference.
5.2. Delivery Address: It is the Customer's responsibility to provide a correct and complete physical delivery address. We are not liable for any delays or losses resulting from an incorrect address.
5.3. Risk: Risk in the Goods passes to the Customer upon handover of the Goods to the courier service. However, in line with the CPA, we remain responsible for the safe delivery of the Goods.
6. Returns, Refunds, and Warranties (CPA Compliance)
6.1. Cancellation Rights (Cooling-off Period - ECTA): As per the ECTA, you are entitled to cancel any transaction for Goods purchased online without reason and without penalty within 7 (seven) days of receipt of the Goods. The Goods must be returned unopened and in their original, unused condition, at your own risk and cost.
6.2. Defective Goods (CPA Section 56): If the Goods fail to meet the required quality standards within 6 (six) months of delivery, you may return the Goods for repair, replacement, or a refund, at your election. We will cover the cost of collecting and assessing the defective Goods. 6.3. Returns Policy: Full details and procedures for all returns are set out in our separate Returns and Refunds Policy, which is incorporated into these Terms by reference.
7. Intellectual Property
7.1. All content on this Website, including text, graphics, logos, images, video clips, data compilations, and software, is the property of Lefa Supply or its content suppliers and is protected by South African and international copyright and trademark laws.
7.2. You may not reproduce, duplicate, copy, sell, or otherwise exploit any content on the Website for any commercial purpose without our express written consent.
8. Limitation of Liability
8.1. Lefa Supply, its directors, employees, and suppliers shall not be liable for any direct, indirect, incidental, or consequential loss or damage arising from the use of the Website, the purchase of Goods, or any non-compliance with these Terms, except as prohibited by the CPA.
8.2. You acknowledge and agree that the use of the Website and the reliance on any content is at your sole risk.
9. Privacy and Data Protection (POPIA Compliance)
